Terms of Sales and Returns Policy for Indomitable Beauty Limited

Indomitable Beauty Limited, a company registered in England and Wales with Company No. 11870152 and with registered address at Kemp House 160 City Road, London EC1V 2NX (“Indomitable Beauty” or “The Company” or “Us” or “We” or “Our”) provides the Website and its features to you (“you” or “User” or “Customer”).

 

These terms of sale (“Terms of Sale”) outline the contract that is formed between Indomitable Beauty Limited and the Customer when making a purchase from our website at www.indomitablebeauty.com (“Website” or “Site”).

 

Introduction

 

These Terms of Sale apply to any sale of any product (“Product”) made on our Site. By purchasing from our Site, you agree to be legally bound by these Terms of Sale in their entirety.

 

When purchasing products from our Site you also agree to be bound by the Terms and Conditions and the Policies listed on our Site.

 

By law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulation 2013 require that we share certain information with you before a legally binding contract between you and us is made.

 

We will provide you with the following key information:

 

  • A description of the Product

  • The total price of the Product

  • How you will pay for the Product

  • All additional delivery charges and any other associated costs

  • Details of the cost of returning any Products to us (“Returns”)

  • Details of how you can cancel

  • Information on the compatibility of digital content with hardware

  • Information about us, Indomitable Beauty Limited

 

The key information is set out below in these Terms of Sales and forms part of the contract between us.

 

1. Ordering from us

 

No contract will exist between us until your order has been expressly accepted by us.

 

After placing an order for a Product through the Website (“Order”), we will acknowledge your Order by email  “(Confirmation Email”). Your Order constitutes your offer to us, and we will confirm our acceptance to you that confirms that your Order has been accepted and your Products will be sent (“Shipping Email”).  Once you have received the Shipping Email from us ,a valid contract (“Contract”) will exist between us.

2. Availability of Products

All Orders are subject to availability. In the event that a Product is no longer available, we reserve the right to give you information about substitute Products of an equal or higher value and quality which you may be able to order.

3. Shipping, Shipping Costs & Delivery

During our pre-order period (until 31st Nov 2021), we will fulfil your order from 1st Dec 2021.

 

Subject to availability (Clause 2) we will endeavour to fulfil your Order as in accordance with the below:

Royal Mail Signed for 1st Class (1-2 business days) £5.20

Royal Mail Signed for 2nd Class (2-3 business days) £4.50

Free Royal Mail Signed for 2nd Class for all orders above £120.

When we receive your order before 12:00 noon on a working day, it will be shipped the same day, and delivered to you within 4 days (not including Sundays and Bank Holidays). Orders placed after 12:00 noon will be processed the next working day. Please note we don’t deliver on Sundays or Bank Holidays.

 

We'll let you know by email once we have received your payment.

When your parcel has been shipped, we'll send you a shipping confirmation email with tracking information.

Shipping rates are in UK Pounds Sterling and will be listed separately on your invoice.

If your package does not arrive within the regular delivery time, please contact us as soon as possible. We can only open an investigation with the courier within 2 weeks of the original delivery date.

We currently do not ship outside the United Kingdom. 

4. Risk and Title

 

The Products will be at your risk from the time of delivery.

 

Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Order including delivery charges.

 

5. Limit on our responsibility

 

Except for any legal responsibility that we cannot exclude in law (death or personal injury), we are not legally responsible for any losses that were not foreseeable to you and us when the Contract was formed or that were not caused by a breach of Contract by us.

 

6. Indemnity

 

You shall indemnify us against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other professional costs and expenses) suffered or incurred by us arising out of or in connection with your breach of any of your obligations under this Contract. 

 

7. Notices

 

Any notice or other communication given to a party under or in connection with the Contract shall be in writing and shall be sent by email to the address specified in the Order.

  

8. Governing law

 

The Contract, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales.

 

9. Jurisdiction

 

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Contract or its subject matter or formation.

RETURNS POLICY

 

We make every effort to ensure you are happy with your purchase. However, if for any reason you change your mind, we accept returns for unused and unopened products within 14 days of delivery. Unfortunately, we cannot offer refunds for used or opened products or products with broken security seals due to hygiene purposes.

 

If more than 14 days have gone by since your Order date, unfortunately, we will not be able to offer you a return. To be eligible for a return, your Product must be unopened, unused and in the same condition that you received it. To complete your return, we require a receipt or proof of purchase. Please notify us of your intent to return your product by email at social@Indomitablebeauty.com. Please include your order number and reason for return and our customer service team will be in touch.

 

We recommend sending your purchase back to us using a tracked and insured service. We are not responsible for delayed, damaged or lost return packages. Please also ensure you pack your return securely. Please be advised that we are not liable for any charges incurred when sending your package to us.

 

Once your return is received and inspected, we will send you an email to notify you that we have received your returned package. We will also notify you of the approval or rejection of your refund. If your return is approved, then your refund will be processed, and a credit will automatically be applied to your original method of payment.

 

Please note that delivery fees are non-refundable.

 

We require up to 5 working days from receiving the returned package to fully process the refund. Please note it may also take additional time for your respective financial institution to return the funds to your bank account.

Unfortunately, it is not possible to make changes to your order once you have placed it. However, we have 14 day return policy for unopened, unused products that are in the same you received them.

ARE THERE FURTHER TAXES TO PAY UPON DELIVERY?

United Kingdom orders will not incur any tax or duty charges upon delivery. We currently do not ship outside the United Kingdom. We will provide updates should this change, on our website and on our social media accounts.

If you have a complaint about a product or service, please contact our customer care team via the contact page on the website, or at social@Indomitablebeauty.com. We will respond to all complaints as soon as possible within 14 days of receipt. Where the processing of your complaint requires more time and attention, we will email you with an indication of when you can expect to receive a full response to your complaint.

If we cannot resolve any disputes using our complaints handling procedure we will consider the need for alternative dispute resolution and, if necessary, provide you with information about any alternative dispute resolution provider we deem appropriate to deal with your complaint.
